NRI / OCI eligibility — who can buy
Under FEMA and the NDI Rules 2019, Indian passport holders (NRIs) and OCI card holders — including those resident in Kenya — are permitted to purchase residential and development-authority-allotted residential plots. Here is what is allowed and what is not.
NRIs and OCIs may purchase residential property and development-authority-allotted residential plots — including YEIDA corridor plots — in India. These are the plot types Vidastu works with.
Agricultural land, farmhouses and plantation properties are not permitted under FEMA for NRIs and OCIs. We only work with permitted categories — confirm eligibility with your CA.
OCI card holders have the same property purchase rights as NRIs for residential and development-authority residential plots. If your family received Kenyan citizenship and holds an OCI card, you remain eligible. Confirm your specific situation with your CA.
Purchase price paid through NRE, NRO or FCNR account via normal banking channels. No cash transactions. Vidastu coordinates with your India-based bank on documentation.

The legal side — in plain English
FEMA and the NDI Rules 2019 permit NRIs and OCIs — including Kenya residents — to purchase residential and YEIDA-allotted residential plots. Your Power of Attorney is attested at the Indian High Commission in Nairobi — Kenya's standard process for legal documents used in India.
