  3. Open the project's registration detail page and find the "proposed date of completion" field. That is the one possession date that carries legal weight — filed under the promoter's own signature to the regulator, not written by a sales team.

Why possession dates slip — and what actually protects you

None of this makes a date certain. It makes a delay legally answerable, with money and paperwork behind it, instead of just a broker's word.

The RERA escrow account

Under Section 4 of the RERA Act, a registered project must route 70% of the amounts realised from buyers and land cost into a separate, project-specific bank account. Funds are released from that account only against an engineer, architect and chartered accountant's certification of construction progress — not on the promoter's say-so.

That structure is why a registered project stalling for lack of funds is a materially harder failure mode than an unregistered one. It doesn't prevent delay; it makes silent fund diversion much harder.

A registered Agreement for Sale

Once you sign, the possession date stops being a verbal promise from a sales call and becomes a term filed with the regulator. Any project alteration needs the written consent of two-thirds of allottees, and any change to the registered completion date requires the promoter to formally file for an extension — on record, not in a WhatsApp message.

Ask for the current, RERA-filed cost sheet and agreement draft in writing before you sign anything. A possession date that can't be shown to you on paper isn't a date.

Delay interest under Section 18

If a promoter fails to deliver by the registered date (plus any sanctioned extension), Section 18 of the RERA Act gives the buyer a choice: withdraw with a full refund plus interest, or stay and claim monthly delay interest at the rate prescribed under the state's own rules — in Uttar Pradesh, that is the State Bank of India's highest Marginal Cost of Lending Rate plus 1%.
